CONFLICT... NO ONE LIKES IT

There seems to be a lot of things that worry us these days. Having conflicts, disputes or complaints about Community CPS problems just doesn't need to be one of them.

Ten Years Back…

"I'll See You In Court" or "Sue Me, I'll Sue You" are powerful threats frequently used to intimidate the average consumer. They make us react irrationally with fear. However, in today's legal system the reality is lawyers are very expensive and courts are backlogged. Lawsuits can take months to schedule, drag out sometimes for years before any kind of resolution is attained. That's a lot of time to get stressed out and sick. Keep reading...

The Webster Dictionary defines the word dispute as "to engage in argument or variance of opinion". The word "dispute" is a general term that includes complaints, disagreements, quarrels, grievances and conflicts. Most disputes are temporary. They come and go. But, some are serious and troublesome. We must take action. The dilemma is: How do we take action?

A Little Known SECRET

There is a legal procedure that most people have not heard about. It will save you money and time. And, it's easy to do. If you are serious and want to take action on your Community CPS issues, keep reading.

Don't be afraid of the big phrase "Alternative Dispute Resolution" also known as ADR. You may have heard about Mediation and Arbitration. These are components of the ADR procedure. ADR is an out-of-court legal procedure that is less formal, faster, cheaper and often less adversarial than a court trial. The good news is ADR has been adopted as a standard legal practice in the United States, European Union and most countries throughout the world. Any individual or business can utilize the ADR procedure without having to hire costly court lawyers or attorneys.

The first step is to resolve the current disputes yourself. Obtain a copy of the Complaints Board book "Do-It-Yourself Guide To Dispute Resolution". Always document your communication in writing. How Is The Complaints Board Different From Court Litigation?

In traditional court litigation, the disputants (plaintiff and defendant) hire lawyers to represent them in court. The lawyers prepare a case to persuade the Judge to make a decision in their favor. Then, the Judge makes a decision and that's it. You have to abide by it. In court, there are no guarantees that either party will come out as the 'victorious winner'. Lawyers use a hostile adversarial approach to discredits the other party's credibility and integrity. Besides monetary cost in legal fees, there are losses in personal relationships and in our overall health. Court is very stressful. Settlements are not always fair. Very often we are dissatisfied with the outcome. Disputes remain unresolved. The solution is to use your rights to Consumer ADR and the Complaints Board instead of going to court.

YOU are in Control

The Community CPS Complaints Board assigns a skilled mediator to oversee the dispute case. Instead of a court trial, the Complaints Board arranges a formal meeting with the disputants to discuss their issues and differences in a safe, neutral environment. The trained neutral mediator is like a dispute referee, support counselor and resolution coach all-in-one. The mediator actively participates with the disputants to facilitate open communication making sure that everyone has the opportunity to talk and say what is really important.

The mediator is not a judge and doesn't make a ruling. The disputants can decide to agree or disagree. The disputants have full control of the decision-making and how they want to resolve their issues. There is none of the fanfare and pressure that comes along with a court trial. It's confidential. There is no outside scrutiny. When both parties have made peace, the items they agree upon are transcribed into a legal document. This legal document is court enforceable should either party not keep their word. Most disputes are settled in one or two days at a cost substantially lower than traditional court litigation.

Fast Forward

For whatever reason you can't see eye to eye and get the issues resolved, you still can go to court. In most Consumer Complaints Board cases, resolution is possible once everyone gets a chance to talk and listen without being interrupted or intimidated. Everyone gains a better understanding of why and how things happened. In the future you gain a better rapport and can talk to each other without feeling defensive. I think we all want that.
